Trashed Lot Endangers Shore Access in Vienna

September 01, 2009 - VIENNA -- Trash and human waste left by visitors to the Kimball Pond boat launch has an adjacent property owner threatening to close the parking area, which sits on his land.

In an e-mail to selectmen, property owner Theo Hunt stated his intent to block access to the parking area because of people "defecating in the wooded area to the right of my parking area ... leaving the napkins, tampons, toilet paper... for all to see and smell."

Selectman Brian Church said he followed up on Hunt's complaint with a visit and confirmed the conditions, calling it "a mess."

Reached by phone Wednesday, Hunt said he is concerned about the effect on water quality because the wooded area is no more than 10 feet from the pond, and some waterfront properties pump water for household use.

Although the woodlands adjacent to the parking area are actually owned by Hunt's neighbor, he said he believes blocking the parking area would reduce the number of visitors and partially alleviate the waste problem. He said he helps his elderly neighbor maintain her land and would clean up the site himself.

Selectmen claim that at least half of the parking lot is within the town's right of way and cannot be blocked. Hunt disputes that, saying his deed and a recent survey show the entire parking area are on his land.

Hunt's e-mail to selectmen included a suggestion that the town rent a portable toilet. Selectmen said they are open to the idea but noted there is no money in this year's budget.

Selectman Chris Smith said he would research the cost of having a portable toilet placed at the boat launch in mid-May through the end of fishing season in September.

"I'm willing to share." Hunt said of the parking area, "but people are abusing the privilege and abusing me."
