New Shoreland Protection Law Takes Effect

October 16, 2007 - YORK - A new law sponsored by Rep. Dawn Hill, D-York, requiring that trees cut in shoreland areas be replaced with trees of similar size and species, is now in effect.

The law requires that developers or individuals who illegally cut down trees in Maine's shoreland area must do more than just pay a fine. Trees and understory vegetation must be replaced by those of a substantially similar size and species.

"My hope is that this will act as a deterrent," said Hill. "Requiring violators to replant will discourage those who display the attitude that fines are the price they pay for their milliondollar view. Currently the fines are simply treated by some developers as part ofthe costs of doing business. I know this law will help to protect the integrity of these areas."

Hill acknowledged in her announcement that the bill has now become the law of the land that the "cut-it-now-and-pay-later" attitude of those violating the state's shoreland protection laws was a source of frustration for many municipal officials. The new law, which received support during its Augusta public hearing from area officials including Kittery Town Manager Jonathan Carter, York Community Development Director Steve Bums and Kennebunkport Code Enforcement Officer Brian Shaw, provides municipalities with a stronger enforcement tool.

The law requires repair and restoration for the damage done to the environment, which Hill said is a more effective result than the payment of a fine. In addition, she said, the law preserves the scenic character of Maine's coast, rivers and lakes, while providing critical protection for Maine's water quality and wildlife.

The law received support ftom such diverse groups as the Department of Environmental Protection, the Maine Municipal Association, the Maine Real Estate and Development Association, the Natural Resources Council of Maine and Maine Audubon.
